These Terms of Service (“Terms”) govern your access to and use of the Empire platform at app.theempireadvantage.com and related services (the “Service”) provided by The Empire Advantage (“Empire,” “we,” “us,” or “our”).
By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility and accounts
You must be at least 18 years old and capable of forming a binding contract to use the Service. By signing up, you confirm that the information you provide is accurate, that you will keep it current, and that you are responsible for safeguarding your account credentials. You are responsible for all activity that occurs under your account.
Empire uses Auth0 for authentication. If you sign in via a social provider (e.g. Google), you are also subject to that provider’s terms.
2. Workspaces, teams, and roles
Each Empire account belongs to a workspace (also called a tenant). The user who creates a workspace becomes its Owner and is responsible for that workspace’s subscription, billing, team membership, and the conduct of its members.
- Owners can invite team members and assign roles.
- Owners can share individual deals with users in other workspaces. Shared users have read or edit access to those specific deals but cannot delete them.
- Deleting a workspace member or removing a deal share removes that user’s access immediately.
3. Subscriptions and billing
Empire offers tiered plans (currently Trial, Core, Pro, and Enterprise). Each plan has different limits on the number of active deals, seats, included comparable-sales lookups, and access to features.
Billing. Paid subscriptions are billed in advance on a recurring basis through Stripe. By subscribing, you authorize Empire and Stripe to charge your payment method for the applicable fees, taxes, and any add-ons (such as additional comp packs) you purchase.
Plan changes. You can upgrade, downgrade, or cancel your subscription at any time from the Account page. Upgrades take effect immediately and are prorated. Downgrades and cancellations take effect at the end of the current billing period. You retain access to paid features until the period ends.
Refunds. Fees are generally non-refundable, except where required by law. If you believe you’ve been billed in error, email support@theempireadvantage.com.
Add-ons. Comp packs and other one-time add-ons are sold on an as-purchased basis. Add-on credits do not expire but are non-refundable once granted.
Trial. Trial accounts are provided free of charge with limited capacity. We may modify trial features and limits at any time.
Past-due accounts. If a payment fails, we may suspend access to paid features until the balance is resolved. We will attempt to notify you before any suspension.
4. Acceptable use
You agree not to:
- Use the Service in violation of any law or third-party right.
- Upload content that infringes intellectual property, violates privacy, or is unlawful, harassing, or defamatory.
- Attempt to gain unauthorized access to any part of the Service or another user’s account.
- Reverse engineer, decompile, scrape, or otherwise misuse the Service or its APIs.
- Interfere with the operation of the Service, including by introducing malware, performing denial-of-service attacks, or sending excessive automated requests.
- Resell, sublicense, or commercially exploit the Service in a way not expressly permitted by your subscription.
- Use the Service to send unsolicited communications or to violate anti-spam laws.
5. Your content and data
You retain all rights to the deal data, files, notes, and other content you submit to the Service (“Your Content”). You grant Empire a limited, worldwide, non-exclusive license to host, process, transmit, display, and back up Your Content solely to operate and improve the Service for you and your workspace.
You are responsible for ensuring you have the right to upload Your Content and for the accuracy of the information you provide.
Deleted deals are placed in a soft-deleted state and can be restored. If you close your account, Your Content will be deleted in accordance with our Privacy Policy.
6. Our intellectual property
Empire and its licensors retain all rights, title, and interest in the Service, including all software, designs, trademarks, and content we provide. We grant you a limited, non-transferable, non-exclusive, revocable right to access and use the Service in accordance with your subscription and these Terms.
7. Third-party services and data
The Service integrates with third-party providers including Auth0 (authentication), Stripe (billing), Amazon Web Services (file storage), and Rentcast (comparable sales data). Your use of those services through Empire is also subject to their respective terms and privacy policies.
Comparable sales data and other third-party information are provided “as is” for informational purposes. Empire does not warrant the accuracy, completeness, or timeliness of data sourced from third parties.
8. Disclaimers and no investment advice
The Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, statutory, or otherwise. To the maximum extent permitted by law, Empire disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade.
Empire is a deal management and decision-tracking tool. It is not a financial advisor, broker, appraiser, or legal counsel. Information presented in the Service — including ARV estimates, comparable sales, profit projections, and rural-status checks — is for informational purposes only. You should independently verify all information and consult appropriate professionals before making investment decisions.
9. Limitation of liability
To the maximum extent permitted by law, Empire and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or business opportunities, arising out of or related to your use of the Service.
Our total liability for any claim arising out of or relating to the Service or these Terms is limited to the greater of (a) the amount you paid Empire in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).
10. Indemnification
You agree to indemnify and hold Empire harmless from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising out of (a) your use of the Service, (b) Your Content, (c) your violation of these Terms, or (d) your violation of any third-party right.
11. Suspension and termination
You may cancel your subscription at any time from the Account page. We may suspend or terminate your access to the Service if we reasonably believe you have violated these Terms, failed to pay amounts owed, or created risk or legal exposure for Empire or other users.
Upon termination, your right to access the Service ends. Provisions that by their nature should survive termination (including ownership, disclaimers, limitations of liability, and indemnification) will survive.
12. Changes to the Service or these Terms
We may modify the Service at any time, including adding, changing, or removing features. We may also update these Terms. If we make material changes, we will notify you by email or by an in-app notice and update the “Last updated” date above. Continued use of the Service after an update constitutes acceptance of the updated Terms.
13. Governing law and disputes
These Terms are governed by the laws of the State of North Carolina, United States, without regard to its conflict-of-law principles. You agree that any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in North Carolina, and you consent to the personal jurisdiction of those courts.
